Marriage contract and real estate

Many believe that the proposal to conclude such an agreement is to confirm that the spouses are not enough to trust each other.  Definitely, from the part of the proposal to conclude a marriage agreement may seem mercantile and unethical. However, it is often a deterrent and does not give spouses to act thoughtlessly.

According to the Family Code of Ukraine, each thing acquired during the marriage, besides individual use things, is the object of the right of the general joint ownership of spouses. So, the terms of the marriage contract can be changed by this rule of law.
The law provides for several options for the conclusion of a marriage contract.  You can make it before the wedding.  You can sign the appropriate papers and at any time marriage.  In this case, the contract begins to act after the notary certification.

What is prescribed in a marriage contract?

 👰 1. The marriage contract is regulated by the property relations between spouses, their property rights and obligations are determined.

 👰 2. The marriage contracts may be identified property rights and obligations of spouses as parents.
 ⠀
 👰 3. The marriage contract cannot regulate the personal relationships of spouses, as well as personal relations between them and children.
 ⠀
 👰 4. The marriage contract cannot reduce the amount of the rights of the child established by the Family Code, as well as to put one of the spouses in an extremely disadvantageous financial situation.

 👰 5. According to a marriage contract, it cannot be transferred to one of the spouses real estate and other property, the right to state registration is subject to state registration.

It is worth noting that in the marriage contract there is a substantial nuance - one of the spouses cannot put another in an extremely disadvantage in the event of a divorce.  Thus, if you suck that after the divorce you have the right to mansion, an apartment and a villa on the ocean, and your second half per lodge in the village, but such a contract has all the chances of being recognized invalid.
